How to Instruct a Barrister (Our Terms of Engagement)
Terms of Instruction
We accept instruction on the following terms only, except where a variation is expressly agreed in writing.
Barristers clerks are not legally trained, and can only assist with administrative matters and the negotiation of fees.
Our clerks can set or agree fees on behalf of the barristers of Leamington Spa Chambers, and clients and solicitors will honour any agreement reached.
Most payments will be required in advance, but where a fee note is raised our clients or their solicitors must pay us in accordance with the terms agreed, or otherwise within 14 days.
In relation to the Cab Rank Rule, this applies usually applies only to solicitor instructions, and will be dependent on the availability and expertise of counsel, and a mutually agreed appropriate fee.
Direct access cases will be taken on at the discretion of the relevant barrister(s). Our barristers reserve the right not to provide services to potential clients, at the barrister’s discretion.
Each of our barristers carries indemnity insurance with the Bar Mutual Indemnity Fund (BMIF) to a minimum of £500,000 cover, with a number of barristers carrying higher cover. Please ask our clerks for more details.
Our barristers reserve the right to withdraw from acting for a client without notice, subject to professional conduct obligations. Counsel may additionally withdraw where fees remain unpaid in advance or despite request, as the case may be.
Our barristers and clerks will need to carry out money laundering checks and similar. We will require documentation to prove the identities of individuals, partnerships, firms, corporates, and other entities.
Solicitors instructions are accepted only on the following terms, except where a different contractual agreement is agreed in advance of work being undertaken.
