Our Fraud Law Expertise

Our criminal law barristers have expertise in representing clients who have been accused of committing fraud or of failing to prevent fraud. Fraud allegations can arise in any walk of life. The alleged fraud could be based on conduct that has occurred (by act or omission), a misunderstanding, or an error in conduct rather than active fraud.

Our Silks (King’s Counsel), Senior and Junior barristers, are highly experienced in defending clients who are facing allegations of committing fraud.

Our barristers can advise on electronic and telecommunications evidence, forensic and DNA evidence, motor vehicle forensic evidence (inc. ANPR), the movement of money or assets, whether other people’ activity undermines the Crown’s case, challenging evidence about an alleged location where the fraud is said to have been occasioned, identity challenges, alibi defences, joint enterprise (accessories to fraud), challenging financial and other expert witnesses, advising on police and defence evidence.

More About Fraud Law Offences and Our Barristers' Services

Our fraud law barristers have defended clients in numerous types of fraud cases, fraud at work, fraud against the public purse, fraud against banks, prescription fraud, fraudulently masquerading as another person or professional for gain, and fraud against the NHS, such as timesheet fraud.

The following non-exhaustive list of legislation covers offences of fraud:

Economic Crime and Corporate Transparency Act 2023 – offences where large corporations fail to prevent fraud by employees and others who act on the corporation’s behalf. For guidance on the application of this law, steps to the prevention of fraud, and on prosecutions of those who fail to prevent fraud under this legislation, see: Economic Crime and Corporate Transparency Act 2023: Guidance to organisations on the offence of failure to prevent fraud (Nov 2024). Our barristers can advise corporations on potential criminal liability, advise on pleas to offences, and advise on mitigation and penalties. Our barristers can represent corporations in court.

Common Questions About Our Services

Leamington Spa Barristers Chambers can meet with clients (defendants) in Chambers, at solicitors’ offices, by videoconference, and in prisons.

What expertise do your barristers have in defending people being prosecuted for fraud?

Our criminal law barristers are highly experienced in representing defendants in criminal trials. Many have years of experience, and have defended in fraud cases where there has been a complicated history and much contested data.

How can I instruct a barrister who defends defendants in fraud cases?

You can schedule an introduction or formal consultation with a fraud law specialist barrister by contacting our clerks.

What will the barrister need to be able advise me in a fraud law case?

For a criminal law barrister specialising in fraud to advise, they will need to see the Crown’s evidence and the defendant’s evidence.

The Crown Prosecution Service (representing the Crown) brings cases to trial, instructing KCs, senior and junior barristers, supported by other lawyers. A defendant should therefore arrange for good representation to counter the Crown’s case.
